1. Acceptance of Terms

By accessing or using Sent Boson ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use the Platform.

2. Platform Description

Sent Boson is a platform for sharing, discovering, and verifying AI-generated video content. We use automated AI detection systems to verify that uploaded content is AI-generated. The Platform is intended solely for AI-created video content. The Platform is currently available only to users located in the United States and India.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Accounts require email verification and may require admin approval before full access is granted. You must be at least 13 years old to create an account. By registering, you confirm that you are 13 or older. We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA).

4. Content Guidelines

All uploaded content must be AI-generated. You must have the right to share the content you upload. Content must comply with our Community Guidelines. We reserve the right to remove content that violates our policies or applicable law.

5. AI Verification

All uploads undergo automated AI verification. Providing a source URL from a recognized AI platform may expedite verification. The Platform's AI confidence scores are algorithmic estimates and not guarantees. Misrepresenting non-AI content as AI-generated may result in account suspension.

6. Intellectual Property

You retain ownership of your uploaded content. By uploading, you grant Sent Boson a non-exclusive, worldwide license to host, display, distribute, and promote your content on the Platform. You may remove your content at any time.

7. Copyright Infringement / DMCA Policy

Sent Boson respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA).

Filing a Takedown Notice: If you believe content on our Platform infringes your copyright, please send a written notice to our Designated Agent with the following information:

• A description of the copyrighted work you claim has been infringed
• The URL or location of the infringing material on the Platform
• Your contact information (name, address, phone number, email)
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

Counter-Notification: If you believe your content was removed in error, you may submit a counter-notification with: your contact information, identification of the removed content, a statement under penalty of perjury that you have a good faith belief the removal was a mistake, and your consent to jurisdiction of the federal court in your district. We will restore the content within 10-14 business days unless the complainant files a court action.

Repeat Infringers: We will terminate the accounts of users who are repeat copyright infringers. Our strike system applies to DMCA violations.

8. Prohibited Conduct

You may not: upload harmful, illegal, or non-AI content; attempt to circumvent AI verification; harass other users; create fake or misleading accounts; use automated tools to scrape or spam the Platform; or interfere with Platform operations.

9. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Platform, including but not limited to loss of data, revenue, or content. Our total liability shall not exceed the amount you paid us (if any) in the past 12 months.

10. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time. Upon termination, your content may be removed from the Platform.

11. AI-Generated Content Policies

All content on the Platform is intended to be AI-generated. Users must accurately label the AI tool used to create their content. The Platform may display "AI-Generated" labels on all content in compliance with applicable law. Users acknowledge that AI-generated content may be subject to evolving legal requirements including the EU AI Act. Users must not upload non-consensual intimate imagery, whether AI-generated or otherwise.

12. Non-Consensual Intimate Imagery (Take It Down Act)

In compliance with the TAKE IT DOWN Act (Public Law 119-10), Sent Boson will remove non-consensual intimate images, including AI-generated deepfakes, within 48 hours of receiving a valid removal request.

To submit a removal request, email dmca@sentboson.com with: the URL of the content, a statement that the image depicts you or a minor and was shared without consent, and your contact information.

We will also take reasonable efforts to remove known copies or duplicates of the reported content.

Knowingly submitting false removal requests may result in account termination.

13. Video Privacy

In accordance with the Video Privacy Protection Act (18 U.S.C. § 2710), we do not share your personally identifiable video viewing information with third parties without your separate, written consent.

Your watch history is used solely to improve your recommendations and is never sold or shared for advertising purposes.

You may delete your watch history at any time through your account settings.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any dispute arising from these Terms shall first be resolved through informal negotiation. You agree to contact us at support@sentboson.com and allow 30 days for resolution before initiating formal proceedings.

If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Either party may seek injunctive relief in a court of competent jurisdiction.

16. Indemnification

You agree to indemnify, defend, and hold harmless Sent Boson, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: your use of the Platform; your uploaded content; your violation of these Terms; or your violation of any third-party rights.

17. Platform Liability (Section 230)

Sent Boson is an interactive computer service under 47 U.S.C. § 230 of the Communications Decency Act. Users, not Sent Boson, are solely responsible for content they create, upload, or share on the Platform.

We may moderate content in good faith without assuming liability for user-generated content.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Sent Boson regarding your use of the Platform and supersede any prior agreements.

20. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify users of significant changes via email or Platform notification.
